  • ESA Motion of Leave to Answer

    Pursuant to Rules 212 and 213 of the Federal Energy Regulatory Commission’s (“FERC” or “Commission”) Rules of Practice and Procedure,1 the Energy Storage Association (“ESA”)2 hereby submits this Answer to Motion to Consolidate and Motion for Leave to Answer and Answer, in response to: (i) the Motion to Consolidate filed by PJM Interconnection L.L.C. (“PJM”) on May 15, 2017 (“Motion to Consolidate”); (ii) the Answer filed by PJM on May 15, 2017 (“PJM Answer”); and (iii) the Comments filed by the Independent Market Monitor (“IMM”) on May 25, 2017 (“IMM Comments”). Each of the foregoing pleadings was filed in Docket No. EL17-64-000 and Docket No. EL17-65-000. Although the Commission’s Rules do not permit answers to answers or protests as a matter of right, the Commission routinely allows such answers where they will aid the Commission’s decision-making process, clarify the issues before the Commission, or assure a complete record in the proceeding.3 Accepting this answer will aid the Commission’s decision-making process by addressing and correcting errors and omissions in the PJM Answer and IMM Comments. Moreover, accepting the answer will promote administrative efficiency by allowing ESA to address the Motion to Consolidate filed by PJM in a single pleading. ESA thus respectfully requests the Commission grant this motion for leave to answer.

    Pursuant to Rules 212 and 213 of the Rules of Practice and Procedure of the Federal Energy Regulatory Commission ("FERC" or the "Commission"), 18 C.F.R.§ 385.212 and 18 C.F.R.§ 385.213, the Energy Storage Association ("ESA"), a national trade association whose members include, but are not limited to, energy storage entities that use batteries, flywheels and compressed air to provide Regulation service hereby moves to answer and answers the filings submitted by ISO-New England, Inc. ("ISO-NE") and the New England Power Pool ("NEPOOL") on April 23, 2014 and April 25, 2014, respectively, in the above-captioned docket.

  • FERC's Order Approving MISO Order 755 Compliance Filing

    On April 30, 2012, the Midwest Independent Transmission System Operator, Inc. (MISO) filed proposed revisions to its Open Access Transmission, Energy and Operating Reserve Markets Tariff (Tariff) to establish a revised compensation methodology for the provision of regulation service, in compliance with Order No. 755.1 MISO asserts that its proposal provides a comprehensive solution by addressing procurement and compensation of frequency regulation service in MISO’s day-ahead and real-time energy and operating reserve markets. Also on April 30, 2012, MISO filed a request for an extension of the October 27, 2012 implementation date to December 17, 2012. In this order, we find that MISO’s proposal is generally compliant with Order No. 755, and we conditionally accept it, subject to certain conditions outlined below, to become effective on December 17, 2012, as requested. We also require MISO to make an additional compliance filing within 30 days of the date of this order and an informational report within 14 months of the effective date of the proposed Tariff revisions, as discussed herein.

  • FERC Order Approving CAISO Order 755 Compliance Filing

    The Commission finds CAISO’s proposed tariff revisions to be just and reasonable and in compliance with the Commission’s final rule concerning compensation for frequency regulation in organized wholesale power markets, subject to the compliance filing directed below. Consistent with Order No. 755, CAISO’s tariff revisions address the requirement that a capacity payment at a uniform clearing price that includes opportunity costs be made to a resource to keep its capacity in reserve in the event that it is needed to provide real-time frequency regulation service. CAISO’s tariff revisions also address the requirement that performance payments reflect the amount of work each resource performs in real-time in response to the system operator’s dispatch signal.
